Jenni Hermoso filed a legal complaint for the kiss of Spanish football federation president Luis Rubiales.
Rubiales kissed Hermoso on the lips after Spain’s final victory in the World Cup, which he said was not consensual.
Rubiales admitted that the kiss was “mutual and “consensual”, but it happened temporarily suspended by football’s world governing body FIFA.
The complaint means the 46-year-old could face criminal charges.
A statement from the national prosecutor’s office said: “Jennifer Hermoso filed an open complaint for the facts that you all know.
“The national court prosecutor’s office will file a complaint as soon as possible. The statement was made by the state attorney’s office to protect the victim’s privacy.”
On August 29, Spanish prosecutors opened a preliminary investigation into whether the incident was a crime of sexual assault.
At the time, Spain’s highest criminal court said it had opened an investigation because of the “unquestionable nature” of the 33-year-old Hermoso’s statements, saying it was necessary “to find out their legal meaning”.
“Given the public statements made by Jennifer Hermoso, the sexual act she was subjected to Luis Rubiales was not consensual,” said a statement.
It added that legal experts will also contact him “to offer him the option of legal action, giving him the opportunity to contact the prosecutors of the National Court within 15 days for information about his rights as a victim of an alleged sexual assault if he or she wishes to file a complaint”.
The statement added: “In order to proceed with a case for sexual assault, harassment or sexual abuse, it is necessary for the injured party or their legal representative to file a case, or the prosecutor’s office in public.”
It was reported that Hermoso filed his complaint on Tuesday.
Rubiales, who before the kiss was seen clutching his crotch while celebrating Spain’s 1-0 win over England, has repeatedly refused to resign from his position.
Last Friday, the national sports tribunal (TAD) in Spain opened a misconduct case against himruling that she committed a “serious offense” by kissing Hermoso.
However, the TAD stopped the “very serious offense” requested by the government that would have led to his suspension.
Some 81 Spain players, including all 23 World Cup winners, have said they will not play for the team again while Rubiales is in charge.
They must play in the UEFA Nations League qualifiers later this month, with games against Sweden and Switzerland on 22 and 26 September.
On Tuesday, Spain’s World Cup-winning head coach Jorge Vilda – considered a close ally of Rubiales – DAVAOwho named Montse Tome as his successor.
The Spanish men’s team criticized Rubiales on Monday for his “unacceptable behaviour”.
However, Spain and Real Madrid defender Dani Carvajal has been criticized for saying he will not judge whether Hermoso is a victim or not until the legal process is over.
Speaking in an interview with Spanish radio Onda Cero on Tuesday, he said: “There are legal bodies that are wondering if Jennifer is really a victim of something that is being investigated.
“There are people who have to decide when someone is guilty and a victim.”
In an attempt to clarify his comments on Wednesday, Carvajal said that “Rubiales must be supported in the same way as Jenni Hermoso” in this process.
He added: “I understand that Jenni is going through a bad time, we have to show my solidarity. But, I don’t think the president is having fun either. I’m not here to judge anyone.
“The presumption of innocence is a constitutional right. You cannot be a victim or be blamed by anyone.”
